Using our dedicated team, any County Court Judgment for over £600.00 (including costs) may be transferred to a High Court Enforcement Officer (HCEO) if the claimant chooses to use execution via the HCEO against the debtor's goods as a method of enforcement.
The Writ of FiFa is the High Court equivalent of the County Court Warrant of Execution although its powers are considerably greater. It provides a command to seize/impound and sell Defendants' goods and chattels to the value of judgment debt plus interest and costs. Many court users are discouraged from transferring up because of the unfamiliarity with the format of the High Court Warrant. We can now take this step for you because we understand the procedure.
How do I transfer my judgment from the County Court to the High Court for enforcement?
We can transfer your judgment for you. all we require is the transfer up instruction form completing, the original or a copy of the Certificate of Judgment sealed by the court and a cheque for the sum of £74.40.
Will I get my transfer fee back?
The court will allow you a fixed fee of £111.75 to cover your disbursements. This is endorsed on the Writ of FiFa and can be recovered from the debtors. (However, if the High Court Enforcement Office is not successful in obtaining payment, the fee is non-refundable.)
After my judgment has been issued and my transfer complete, what happens next?
You will be advised of the details of the designated officer who will then attend the Defendant's premises, usually within 72 hours of receipt of the warrant at their office. They will then, in turn, report to you directly as to the action which has been taken.
